The Federal Court has advised that the current Federal Court (Bankruptcy) Rules 2005, as well as the Federal Circuit Court (Bankruptcy) Rules 2006, will be automatically repealed as a result of the operation of the sunsetting provisions contained in Part 4 of Chapter 3 of the principal legislation.

From 1 April 2016, the Federal Court (Bankruptcy) Rules 2016 will replace the current Federal Court (Bankruptcy) Rules 2005. Similarly, the Federal Circuit Court (Bankruptcy) Rules 2016 will replace the current Federal Circuit Court (Bankruptcy) Rules 2006.

John Mathieson,  Deputy Registrar advises “The replacement Rules for each Court have been developed, in consultation with the Office of Parliamentary Counsel, with significant input from Judges and Registrars, as harmonised rules for proceedings in both Courts in bankruptcy. The Federal Court’s new Bankruptcy Rules incorporate the harmonised rules for proceedings brought before the Federal Court under the Cross-Border Insolvency Act as Part 14.”
